Terms and Conditions

The promoter of this competition is Aware Super Pty Ltd ABN 11 118 202 672, AFSL 293340 (‘Promoter’ or ‘Aware Super’) as the trustee of Aware Super ABN 53 226 460 365 (‘Fund’) located at Level 28, 388 George Street, Sydney NSW 2000, GPO BOX 89

By entering in the Aware Super FAAA Giveaway Draw (‘Draw’), you are agreeing to the following terms and conditions:

Eligibility to enter

1. The Draw is open to registered delegates, aged 18 years and over, that attend the FAAA Congress 2024, held from November 26th – 29th 2024 at the Brisbane Convention Centre (The FAAA Congress).

2. In entering the Draw, you (‘Entrant’)

  • confirm you are eligible:
    (I) to enter the Draw; and
    (ii) to claim the prize up to the value of $300; and
  • consent to any personal information you provide in entering the Draw being used by the Promoter for the purposes of administering the prize draw, and for those purposes as defined within our privacy notice. How we collect, use, hold and disclose personal information is detailed in our Privacy Policy, available at aware.com.au/privacy.
     

3. A maximum of two entries per person is permitted.

4. The Draw is free to enter.

5. Directors, officers and employees of the Promoter and its related entities (and their immediate family members) and the Promoter's agents and service providers are ineligible to enter the competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child, or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister, or first cousin. 

6. Directors, officers, and employees of businesses that are exhibiting at the FAAA Congress or attending in a commercial capacity are ineligible to enter the competition.

How to enter

7. To enter the Draw an Entrant must scan the QR Code located at the Aware Super stand (Premium Stand 8) at the FAAA congress between 9am on November 27th, 2024, and 12pm on November 29th, 2024, and follow the prompts to:

  • Enter their contact details
  • Consent (Opt-in) to receiving marketing and communications from Aware Super
  • For a bonus entry the entrant can also click the ‘Follow us on LinkedIn’ button and agree to follow the Aware Super for Advisers page here https://www.linkedin.com/showcase/aware-super-advisers
     

Entry period

8. The competition will commence at 9am (AEST) on 27th November 2024 and will close at 11am (AEST) on 29th November 2024 (‘Promotional Period’).

9. During the Promotional Period, there will be one (1) draw conducted on the date and time provided below. All valid entries submitted during the Promotional Period will be entered into the draw.

10. There is a limit of two entries per Entrant for the Draw.

  • First entry: Opt-in to receiving marketing and communications from Aware Super
  • Second entry: Follow the Aware Super for Advisers LinkedIn page before the end of the Promotional Period. 
     

Prize Draw

11. The prize for the Draw is a cocktail hamper valued at $139 which will be awarded to 3 winners will each be awarded a prize. 

12. The prize is not transferable and is not redeemable for cash. 

13. The draw will take place at the Promoter’s office located at Level 28, 388 George Street Sydney NSW 2000 on the date and time specified in the table below. The winning entry will be selected at random using an electronic draw system. The Promoter may draw additional reserve entries and record them in case an invalid entry or ineligible entrant is drawn.

14. The prize winner, determined by chance, will be notified via email by the Promoter on the date provided in the table above.

15. The results of the competition will be published online from no later than 6th December 2024 at www.aware.com.au/adviser/faaacompetition  

16. The prize will be distributed to the winning entrant via registered post within (4) four weeks after the Prize Draw date.  

17. If for any reason a prize winner does not claim the prize (or an element of the prize) by the time of the Unclaimed Prize Draw outlined in the table above, then the prize (or that element of the prize) will be forfeited. This information will be published online at www.aware.com.au/adviser/faaacompetition  

18. A draw for an unclaimed or forfeited prize may take place on the date and time outlined in the table above at the Promoter’s office located at Level 28, 388 George Street Sydney NSW 2000 subject to any directions from a regulatory authority. Winners of the Unclaimed Prize Draw (if any) will be notified by the Promoter on the dates provided in the table above, by email and the results of this lottery will be published online from no later than January 21st 2025 at www.aware.com.au/adviser/faaacompetition  

19. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

Promoter's rights

20. The Promoter reserves the right to cancel, terminate, modify or suspend the Draw at any time without prior notice. This right is an absolute discretion.

21. The Promoter reserves the right to disqualify an entrant who is involved in any way with interfering or tampering with the conduct of this Draw.

22. The decision of the Promoter regarding any aspect of the Draw is final and binding and no correspondence will be entered into.

23. Errors and omissions may be accepted at the Promoter’s discretion.

24. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

25. As a condition of accepting a prize, the prize winner must sign any legal documentation as and, in the form, required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

26. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, state of emergency, pandemic, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, or to modify the prize as appropriate.

27. If the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter reserves the right to substitute a different prize of equal or greater value from an alternative supplier.

Limitation on Promoter's liability

28. All validity claims with respect to the prize must be directed to the applicable retailer, not the Promoter.

29. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the prize except for any liability which cannot be excluded by law.

30. Nothing in these Terms & Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms & Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use or redemption of a prize.

32. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this competition if the deficiency is occasioned by a cause outside the reasonable control of the Promoter.

33. The Promoter will not be responsible for any cost associated with an entrant accessing the promotional website.

Privacy

34. In addition to the consent provided in paragraph 19 above, the Promoter collects personal information in order to conduct the competition and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this personal information.

35. The information you provide as part of this competition is collected by the Promoter, in accordance with the Australian Privacy Principles of the Privacy Act 1988 (Cth).

36. The Promoter will use and handle the personal information you provide in accordance with its Privacy Policy. For further information about how your personal information is handled, please phone Customer Service on 1300 650 873 or visit aware.com.au/privacy. The Privacy Policy contains information about how you may access and seek correction of your personal information, how you may complain about a breach of your privacy and other important information about how your personal information is collected, used and disclosed.

All entries become the property of the Promoter.

 

37. Jurisdiction and Dispute Resolution

38. The Draw and these terms and conditions will be governed by the law of New South Wales and any disputes will be subject to the exclusive jurisdiction of New South Wales; including but not limited to alternative dispute resolution processes available in New South Wales.

39. Each party will bear its own costs in implementing a dispute resolution process.
